News, Publications, & Events

Jon Kibbe specializes in representing investment banks, hedge funds, financial institutions and other participants in the credit derivatives, bank loan and high-yield debt markets. His practice focuses on financing transactions involving special situation investments and event driven corporate acquisitions, and often involves bankruptcy and reorganization matters. He regularly provides advice to clients on lending matters, evolving financial instruments and products in the distressed asset class (including options, credit default swaps, total return swaps and related derivatives), as well as matters involving the securitization of portfolios of debt instruments, including CDOs structured to purchase and ultimately restructure distressed bank loan obligations. The distressed CDO transactions include the issuance of rated-notes backed by the cash flows and other recoveries generated solely by the distressed commercial and industrial loans.

In 2006, Mr. Kibbe was an active member of the Blue Mountain working group that helped to develop and draft the North American Syndicated Secured Loan Credit Default Swap (LCDS). He has worked with clients, including investment banks and hedge funds, to structure single name and portfolio transactions utilizing the newly-developed LCDS technology. He is currently active in the development of the European version of the North American product, which will need to reflect and harmonize the underlying differences between the North American and European loan markets, and the divergent needs of North American and European LCDS market participants. He is a regular speaker on topics relating to the U.S. and international distressed loan market and related derivatives products.
