An article by Richards Kibbe & Orbe LLP partner Jon Kibbe titled “Participations in Commercial Bank Loans” was published in the Consumer Finance Law Quarterly Report. In the article, Mr. Kibbe addressed reasons why today’s secondary loan market warrants increased focus on grantor and participant credit risk. Mr. Kibbe discussed the existing legal constructs that favor participants who are able to identify grantor credit risk and structure participation arrangements to reduce the economic downside of a grantor’s insolvency and act vigilantly to protect their positions at the first sign of counterparty insolvency.
