Richards Kibbe & Orbe LLP partners Paul B. Haskel and H. Rowan Gaither authored an article titled “When Good Trades Go Bad,” published in the LSTA Loan Market Chronicle 2013. Every year, thousands of distressed loan trades and claims trades close without any problems. In the article, Messrs. Haskel and Gaither address situations where what should have been a routine trade may veer into an open dispute with a counterparty or even full-blown litigation. They offer insight into questions of the parties’ rights, the calculation of damages and the ability to use the written record to avoid litigation and get the trade to settle.
